Florame may also collect other data to better understand how visitors use the Florame.com website (how often the different website pages are consulted, sales statistics and the provenance of visitors, etc.).

2. OFFERS AND PRICES
All the products for sale on the Florame.com website are restricted to continental France, Corsica, Monaco and foreign countries where we have no distributor (unless otherwise agreed). The promotional offers are only valid within the dual limit of the valid duration of the offer and available stocks.
The prices on this website are given in Euros (Pounds Sterling and US Dollars on the English-language version) included all taxes and excluding shipping costs. The prices may vary during the year, although any products ordered will be billed at the prices applying on the date the order was made. Shipping costs vary depending on weight and destination. For deliveries to continental France, Corsica and Monaco, the carriage is free-of-charge with every order totalling 39 euros including VAT and over.
Title retention clause: products remain the property of Les Relais de Florame until the payment in full has been received.
3. PRODUCT AVAILABILITY
All the product offers proposed on the website are only valid within the limit of available stocks. A coupon code can only be used once per order. You will be notified within 8 days in case of shortages. You may, if you want, ask to cancel (refund by cheque within 15 days) or exchange your order by calling us at 04.90.92.54.50, Monday to Friday, from 9 am – 12 noon and 2 pm to 6 pm or by writing to us at the following e-mail address vpc@florame.fr.
4. HOW TO ORDER
• You select the item(s) you want to buy and add them to your Shopping Basket (you can check the content of your shopping basket and the relevant prices at any time and make any necessary change).
• You identify yourself (e-mail and password). If you are a new customer, you need to create an account and identify yourself by entering a valid e-mail address and a password (private and confidential) which you will subsequently use to identify yourself on the website. You select and confirm the delivery and payment method from the options proposed.
• Providing the necessary personal data for us to process and deliver your orders is mandatory. When you confirm your order by clicking on the “End” button, you declare your agreement to this as well as to all these general terms and conditions of sale. Our Customer Service Department will then process your order.
• You will be sent a detailed order acknowledgement by e-mail once your order is registered. This order acknowledgement summarizes the key elements of your order: the exact sum billed and the delivery method. You accept that our order registration systems are deemed proof of the nature of the transaction and its date.
• Les Relais de Florame reserves the right to cancel any order by a customer with whom there has been a payment dispute on a previous order, or for any other legitimate reason, particularly relative to the unusual nature of the order.
5. PAYMENT
Your purchases on the website are exclusively paid in Euros. The English version of our website displays Pound Sterling and US Dollar prices strictly for information purposes to assist our customers, without affecting the currency of the final transaction, which must be in Euros.
Payment terms: payment on order by cheque, gift voucher and/or loyalty points, or deferred payment by cheque (France only).
In case of payment on order by credit card, the card will be debited when the order is made. To help you shop in complete safety, our online payment by credit card is wholly secure. The entire transaction is encrypted to a bank validation server in SSL mode (Secure Socket Layer). Payments by American Express, Maestro and Electron cards are not accepted.
6. DELIVERY
Our sales and prices are quoted ex works Saint Rémy de Provence (13210) in France.
The products are delivered in continental France, Corsica, Monaco and foreign countries where Florame has no distributor (unless otherwise agreed), to the address you specify when making your order. It is up to you to provide us with all the necessary details to deliver your orders.
Average delivery time: 72 hours after Les Relais de Florame receives your order, and no later than 10 business days after confirmation of your order (unless out-of-stock).
For the parcels shipped to you by post, we negotiate the registered parcel costs, on your behalf, with our distributors, notably the Post Office. These costs, included in the contribution to shipping costs, are not charged for orders totalling 39 euros or over (valid only in continental France, Corsica and Monaco).
7. PRODUCT RETURNS
If a product does not satisfy you, all you have to do is return it to the following address: Les Relais de Florame, 8 Allée de la Garance - ZA de la Gare - BP 95, 13533 Saint Rémy de Provence cedex, at your expense, in the original packaging and in perfect condition, within 10 days of receiving it.
We undertake to exchange the returned product or, if you prefer, to refund you by cheque within 15 days of receiving it, under the following terms:
• the parcel is returned unopened: we refund you the price of the parcel and the shipping costs, if any;
• the product is returned by your choice: we refund you the price of the product, the return shipment costs remain at your charge.
• the product is returned for reasons falling under our liability: we refund you the product, the shipping cost and the return shipment cost, if any.
8. BAN ON UNAUTHORIZED SALES CHANNELS
Our products are designed to be sold through our distribution networks. Sales or free delivery of our products with a view to resale is strictly forbidden, particularly on websites.
9. LIABILITY
The products proposed on the Florame.com website are in conformity with the applicable French legislation.
Les Relais de Florame may not be held liable for breach of contract in case of out-of-stock or unavailable products, force majeure or total or partial disruption or strike by postal services and transport and/or communication means. Florame may not be held liable for any indirect losses resulting from these general terms and conditions of sale, operating loss, profit loss, foreign exchange loss, damage or costs.
Les Relais de Florame reminds you that non-emancipated minors may not contract in application of article 1124 of the French Civil Code. Consequently, orders intended for minors are subject to parental authority. In case of accidental collection of personal data relative to a minor, the parental authority may object to its storage and/or transmission to third parties.
Hyperlinks may refer visitors to other websites. Florame refuses to bear any liability if, despite its vigilance, the content of the said websites infringes the applicable legal and regulatory provisions.
Furthermore, Florame stipulates that the creation of any hyperlink to the home page of this website, or to any other page thereof, is subject to Florame’s express prior written agreement.
10. INTELLECTUAL PROPERTY
Pursuant to the laws governing title to literary and artistic rights or other similar rights, this website and all the elements, brands, drawings, models, logos or artwork on this website, as well as the compilation thereof, are the exclusive property of Les Relais de Florame or of its suppliers, the latter granting no licence or other rights other than the right to consult the website.
The reproduction or use of all or part of these elements is authorized for the sole, exclusive purpose of information for personal, private use. Any reproduction and use of copies made for other purposes is expressly forbidden. Any other use constitutes an infringement, punishable under Intellectual Property law, barring Florame’s prior written authorization.
11. JURISDICTION
This agreement is governed by French law. In case of dispute, French courts have sole competence.
12. MODIFICATION OF GENERAL TERMS AND CONDITIONS OF SALE
In light of the possible changes to the website, Les Relais de Florame reserves the right to adapt or to modify these general terms and conditions of sale at any time. The new general terms and conditions of sale, if any, will be made known to the customer by online modification and they will only be applicable to sales made after the modification.
